Unlicensed construction contracting in Virginia is a Class 1 Misdemeanor (the first 2 times) and a Class 6 Felony (the third time)!
You may be in violation of state law prohibiting illegal contracting, which includes painting, home improvement, roofing, etc., without a license. Even if you have a local business license, or a contractor license in another state, in most cases you are also required to hold a state license from the Virginia Board for Contractors. Pre-License education is required for ALL new contractor's licenses, and is a completely separate requirement from the Class A and B exams.
Before getting a contractor's license, Pre-License education MUST be completed by: • a member of Responsible Management or Designated Employee for a Class A or B license • a member of Responsible Management for a Class C license
"Responsible Management" means the following individuals: 1. the sole proprietor of a sole proprietorship 2. the partners of a general partnership 3. the managing partners of a limited partnership 4. the officers of a corporation 5. the managers of a limited liability company 6. the officers or directors of an association or both 7. individuals in other business entities having a fiduciary responsibility to the firm
Many companies send two people to the Pre-License course. Why? Because, if only one person from the company has met the requirements for licensure, and that person leaves, the company must have a replacement within 90 days.
